LOCAL MEMORANDUM OF UNDERSTANDING
2000 - 2003 LOCAL MEMORANDUM OF UNDERSTANDING BETWEEN UNITED STATES POSTAL SERVICE MONMOUTH P&DC/RED BANK 07799 AND AMERICAN POSTAL WORKERS UNION, AFL-CIO

IN ACCORDANCE WITH ARTICLE XXX OF THE NATIONAL AGREEMENT, THE FOLLOWING ITEMS SHALL CONSTITUTE THE LOCAL MEMORANDA OF UNDERSTANDING IN RED BANK, NJ 07799. 1. Wash up time The past management policy on wash-up time will be continued.
2. The establishment of a regular work week of five days with either fixed or rotating days off A. All crafts represented by the APWU will have a fixed work day schedule. The local President will provide full input into the decision on non-fixed rest days. B. Management shall make every effort to establish by the Wednesday preceding the next service week, the non-scheduled day of each part-time flexible employee. This schedule may be subject to change in accordance with the needs of the Postal Service, as determined by management.
3. Guidelines for the curtailment or termination of postal operations A. In the event that the Postmaster has decided to grant administrative leave, in accordance with the Employee and Labor Relations Manual, Section 519, the APWU President or other union official shall be notified of the Postmaster's decision. B. When an employee(s) submits a 3971 requesting Administrative Leave (AD Leave) due to conditions caused by "Acts of God" the appropriate management official will make a decision within a reasonable amount of time.
4. Formulation of local leave program ******** *Management has sent the following italicized item to impasse* A. Clerk Craft Annual leave during the choice vacation period shall be individually selected on an office wide seniority basis regardless of tour. ******** B. Maintenance Craft Annual leave during the choice vacation period shall be selected by occupational group and tour, based on the seniority formula of 38.2.F of the CBA. C. Any employee who has been granted leave during the choice vacation period for any week in which the maximum quota of employees is scheduled off; and subsequently for any reason wants to relinquish said week, should notify the personnel office as soon as possible and the vacated leave week(s) shall be posted for a period of five days and awarded to the senior bidder. D. After an employee's selection of leave during the choice vacation period has been granted, the employee should be on leave for the entire week(s). However if an employee wants to use only a portion of the leave they have been granted during the choice vacation period they may do so, however, it is the responsibility of the employee to inform management the Wednesday preceding the choice vacation week. Management has the right to deny walk-in cancellations.
5. The duration of the choice vacation period(s) The choice vacation period shall be from the first Monday in May and continue for twenty-six (26) consecutive weeks.
6. The beginning day of an employee's choice vacation period The vacation week shall begin on a Monday and end on a Sunday regardless of the employee's basic work week.
7. Selections during the choice vacation period A. Employees who earn thirteen (13) days Annual Leave per year shall be granted up to ten (10) days during the Choice Vacation Period. Said employees shall have a maximum of two (2) selections during the Choice Vacation Period. B. Employees who earn twenty (20) or twenty-six (26) days Annual Leave per year shall be granted up to three (3) weeks of Annual Leave during the Choice Vacation period. Said employees shall have a maximum of two (2) selections during the Choice Vacation period.
8. Whether jury duty or attendance at state or national conventions shall be charged to the Choice Vacation Period A. An employee chosen for Jury Duty during the Choice Vacation Period shall not have to forfeit the selection to which the employee would be entitled. Such employee would be afforded another opportunity to make another selection during the choice period. Any cancellation during any such vacation week shall not be filled in excess of the weekly allowable maximum. B. Attendance at a National or State Convention shall not be charged to an employee's Choice Vacation selection. Up to three (3) delegates, in excess of the allowable maximum, shall be permitted Annual Leave in order to attend such conventions. Any cancellations during any such week shall not be filled in excess of the weekly allowable maximum. 9. Maximum number of employees permitted annual leave during the Choice Vacation Period A. Clerk Craft The maximum number of Clerks allowed annual leave during the months of June, July, and August shall be twelve percent (12%) of the total amount of Clerk Craft employees on the rolls as of February 1st of each leave year. During the months of May, September, and October this amount will be ten percent (10%). ******** *Management has sent the following italicized item to impasse* B. Maintenance Craft The maximum number of maintenance employees allowed annual leave during the choice vacation period shall be computed as follows: Twenty-five percent (25%) from each occupational group by tour. Any fraction remaining from this calculation shall be rounded up. ********
10. Official notification to employees of the vacation schedule for such employees The approved vacation schedule will be posted on the bulletin boards. In addition the employees shall receive their approved vacation schedule no later than March 1st through their immediate supervisor.
11. Notification of the beginning of the leave year No later than November 1st of each year, the employer will post on all bulletin boards a notice informing employees of the date that the new leave year shall begin.
12. Annual leave applications for other than the choice vacation period A. Requests for annual leave for other than the choice vacation period shall be based on the date the 3971 was submitted with seniority prevailing. B. PS form 3971 should be submitted in duplicate as soon as possible to the employees' immediate supervisor. The supervisor shall then sign the form acknowledging the date received and a copy returned to the employee. C. Leave requests can be submitted sixty (60) days in advance. This leave request will be acted upon within 72 hours of receipt.
13. Methods of selecting employees to work a holiday The following shall be the "pecking order" used in scheduling employees within each category to work a holiday or day designated as their holiday. A. Casuals, even if overtime is necessary. B. Part-time flexibles, even if overtime is necessary. C. Full-time and part-time regular employees in order of seniority who have volunteered to work on a holiday or a designated holiday regardless of whether or not such day is part of the employees regular work schedule. D. Full-time and part-time regular employees in reverse order of seniority who have not volunteered to work on a holiday or a designated holiday regardless of whether or not such day is part of the employees regular work schedule.
*The Local Union has sent the following italicized item to impasse* 14. Overtime Desired Lists All overtime lists shall be by section and tour. For this item only, sections are defined as follows: (1). FSM Operators (2). SPBS Operators (3). Mail Processors (4). Express Mail (5). Registry Room (6). Expeditors (7). Manual Distribution (8). AFSM 100 Processors ******** Any newly created mailprocessor positions and/or other positions will be negotiated at the local level. The tour of a clerk employee, including CFS, shall be based on the start time of the majority of the employee's scheduled days as follows: Tour 2: 5:01-9:00am Tour 2A: 9:01-12:59am Tour 3: 13:00-17:00pm Tour 3A: 17:01-20:59pm Tour 1: 21:00-1:00am Tour 1A: 1:01-5:00am These above hours shall not apply to employees at Red Bank Main, its Stations or Branches. A. Clerk Craft 1. There shall be two overtime desired lists. One for opportunities of less than 8 hours and the other for opportunities of eight hours or more. Overtime opportunities for less than eight (8) hours shall be rotated. Overtime opportunities for an employees non-scheduled day shall be rotated for each individual day. 2. Management will permit any employee who transfers into an installation, is converted to career, bids to a different tour or installation during a quarter, will be afforded within seven (7) calendar days of that effective date an opportunity to request to be placed on the overtime desired list(s). These requests will be made to the functional manager and that change generated by that manager. B. Maintenance Craft 1. Employees shall be solicited for overtime by occupational groups and tours. 2. There shall be two overtime desired lists. One for opportunities of less than 8 hours and the other for opportunities of eight hours or more. Overtime opportunities for less than eight (8) hours shall be rotated. Overtime opportunities for an employees non-scheduled day shall be rotated for each individual day. 3. Management will permit any employee who transfers into an installation, is converted to career, bids to a different tour or installation during a quarter, will be afforded within seven (7) calendar days of that effective date an opportunity to request to be placed on the overtime desired list(s). These requests will be made to personnel and that change generated by the personnel department.
15. Light duty assignments The number reserved for temporary or permanent light duty assignments. A. There will be no set number of light duty assignments permanently identified. B. Temporary light duty assignments shall be established on an as needed basis in conformance with the national agreement. C. The light duties shall be determined on the basis of need with full and prime consideration to the type of injury or disability in a consultation with the union for the crafts covered by the APWU. D. Should the need for permanent light duty assignments arise, the formulation of the assignment will be made by consultation in accordance with the national agreement.
16. & 17. Light duty assignments not to be to the detriment of the regular work force employees and assignments that are to be considered light duty A. Any crossing of craft lines in temporary or permanent light duty assignments shall not be to the detriment of any career employee of the craft to which assigned. B. The president or his/her designee shall be notified by the employer when a light duty assignment will cross craft lines. C. Employees, other than clerks, who are given light duty assignments shall not distribute mail requiring scheme knowledge. D. Every effort will be made to modify an employee's present assignment to conform to his/her medical limitations. E. When an employee requests light duty, the USPS will make every effort toward assigning the employee to light duty consistent with the employees medically defined work limitations.
*The Local Union has sent the following italicized item to impasse* 18. The identification of assignments comprising a section, when it is proposed to permanently reassign within an installation employees excess to the needs of a section, as per Article 12 section 5-C-4 of the National Agreement A. Clerk Craft All tours will comprise separate sections. In addition the tours will be further subdivided as follows: 1) Manual Distribution--P&DC 2) MPFSM Operators 3) Office Personnel with Clerk-Typing Skills 4) Office Personnel with Incidental Typing Skills 5) Office Personnel with Clerk/Steno Skills 6) Office Personnel with no typing skills 7) Bulk Mail--P&DC 8) Expeditors 9) Mail Processors 10) CFS 11) SPBS Operators 12) Window Clerks at Red Bank Main and Branches 13) All other Clerks at Red Bank Main and Branches 14) AFSM 100 Processors ************ B. In clerk positions where there exists more than 1 duty. The position is put into the section where more than 50% of the time spent by the person in the position exists. C. Maintenance Craft All tours and occupational groups will comprise separate sections. D. Due to the unknown potential effects of automation section 18 (eighteen) of this agreement may be modified, only by mutual consent of both parties.
19. Assignment of Parking A. The employer shall make every effort to supply adequate parking for craft employees at each facility. B. Ten parking spaces shall be provided by management for the APWU at the Monmouth P&DC and one at the Red Bank Main, as agreed to by both parties. ************ *Management has sent the following italicized item to impasse* 21. & 22. Local negotiated items from craft supplement and implementation of the agreement relating to seniority, reassignment and posting A. Postings, Clerk Craft In addition to Article XII of the 1987 National Agreement, the parties agree to abide by the following for the clerk craft: 1) The deletion of any scheme requirements shall not require the reposting of a duty assignment. 2) The addition of any scheme requirement to any duty assignment shall require the reposting of the duty assignment. 3) No assignment will be posted for bid because of a change in starting time unless the change exceeds one (1) hour from present starting time. Aggregate time changes in a position, which change the starting time more than one (1) hour during the life of the contract, shall be reposted, the incumbent shall not have the option of accepting the new reporting time if it exceeds one hour aggregate. 4) No assignment shall be posted for bid unless there is a change of more than forty percent (40%) of the principle duty assignment. 5) Any change in the location of a bid assignment shall require the position to be reposted, except as provided in the following: Reposting shall not be required when the location is changed due to the movement of an entire facility, branch, station, or operation from one physical site to another. ************ B. Posting of Vacancies, Clerk Craft 1) Vacancies shall be posted on a Wednesday and shall close on the Wednesday of the following week (7th day). ************ 2) To prevent overlapping bids, no vacancies shall be posted before the awards of the previous bids have been posted. 3) Awards shall be posted on Wednesday following the closing date for bids. C. Eligibility of other than senior bidder, clerk craft 1) During the deferment period, the senior bidder who is qualified normally shall be detailed to the position if necessary. 2) The list of employees bidding for a scheme position shall be posted along with their seniority numbers, according to seniority down to and including the senior qualified bidder. 3) An unqualified senior bidder who is subsequently the successful bidder for a later posting requiring scheme knowledge, shall forfeit his position as an eligible candidate for the previous posting. 4) Any employee during the scheme deferment period can rescind his/her bid by submitting a written statement before the expiration of same as per the National Agreement. D. Postings, Maintenance Craft 1) If an assignment is changed by more than two (2) hours, the affected assignment shall be reposted by notice of intent. 2) No assignment shall be posted for bid unless there is a change of more than twenty percent (20%) of the duties or principle assignment areas. E. Seniority Management shall post the current seniority roster on all bulletin boards each quarter. The union shall be provided with a copy of the seniority roster. Leave for blood donations to the blood bank operated on a non-profit basis for the crafts represented by the Red Bank Local. Up to four (4) hours of leave will be granted for absences from the regular tour during the basic workweek and only on the day of the blood donation. Employees volunteering to donate blood are required to submit application (form 3971) at least one week in advance to their immediate supervisor. This leave does not apply to those employees donation on their off duty time. G. Labor/Management Committee It is agreed that the employer will call and schedule bimonthly meetings with the official representatives of the union. Such meetings to be held on the first Wednesday of: January, March, May, July, September, and November. Special meetings may be called by either party upon request or at least twenty-four (24) hours in advance in emergencies. It is agreed that agenda items for discussion at the bimonthly meetings, shall be exchanged by the parties to this agreement no later than Friday prior to the scheduled meeting. Items not placed on such agenda may be discussed only by mutual consent of the parties. There shall be no more than five (5) representatives from the union in attendance. It shall be the responsibility of each party to keep their own minutes. Items agreed upon will be initialed by both parties and posted.
MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding, entered into on this date, at Monmouth P&DC, Red Bank, NJ 07799, between the representative of the United States Postal Service and the designated agent of the union signatory to the National Agreement, pursuant to the Local Implementation Provision of the 2000 National Agreement, shall continue in full force and effect from its effective date until such time as subsequent National Agreement sets timetable for renewing said agreement.
